Accident on Holiday
Isn't it just the greatest feeling when you go on holiday and leave your troubles behind for a week or two? The only thing is; sometimes things don't quite go according to plan. Occasionally, accidents on holiday or abroad do happen and it can be confusing and VERY worrying when you need to make a claim.
Accidents abroad can usually be divided under three main headings:
- Package holiday accidents
- Accidents abroad caused by UK nationals
- Other accidents abroad
Package holiday accidents
If your accident occurred whilst you were abroad on a package holiday which was booked in the UK, you can use a personal injury expert to make a claim in the UK against the holiday company. In order to make a claim against the holiday company, the accident would need to be the fault of the travel agent or their representatives (for example, the hotel staff, badly maintained pavements within the hotel grounds, food poisoning from the hotel restaurant etc).
If your accident occurred outside of the hotel grounds however, you would not be able to make a personal injury claim against the holiday company. If your accident was the result of taking part in leisure activities such as banana boat rides, waterskiing, motor biking, snorkeling etc which were arranged by you with independent companies, there may be no liability under the Package Tour regulations regime.
It is possible to pursue a claim in the country that the company responsible for your injury are based, but this can be tricky as separate local legal advice would be required which can be expensive and complicated.

Accidents abroad caused by UK nationals

Other accidents abroad
If you have had an accident whilst you have been living and working abroad and cannot link the accident back to the UK in any way then you will not be able to use a UK lawyer to pursue your claim as it will be out of their jurisdiction. Your claim will therefore be subject to foreign law (the law of the country you had the accident in) and will therefore require a claims expert based in the country that you were living/working in at the time of the accident.
